Senator Bacon Introduces Legislation To Protect Ohio Consumers
Regulating air duct cleaning services

State Senator Kevin Bacon (R- Village of Minerva Park) introduced legislation today to improve the practices of air duct cleaning services in Ohio. Bacon recognized the need for regulation after watching an investigative report detailing instances in Ohio where consumers bought air duct cleaning services, only to encounter shoddy workmanship, uninsured vendors and pressure to purchase products and services that were unnecessary.

"While many air duct cleaning vendors provide trustworthy service, the questionable practices of others are jeopardizing the credibility of the entire industry," Bacon said. "This legislation will help protect consumers and ensure that vendors operating in Ohio are registered and carry the appropriate insurance."

Under the proposed bill, servicers would be required to register with the Ohio Department of Commerce before advertising or performing their services. The registration would include proof of financial responsibility and a history of work experience. Consumers would be able to search and verify a vendor's registration using an internet database maintained by the Department of Commerce.

In addition, vendors would not be able to perform any services unless a written contract has been executed with the consumer. They would also be prohibited from misrepresenting whether any dangerous substances, such as mold, are present in vents. Unscrupulous vendors will make up such conditions with the sole purpose to con the customer into paying for additional unnecessary services. Violations of these provisions would fall under the Consumer Sales and Practices Act.
